Insurance fraud is a serious crime in Florida, and insurance companies have a duty to report any claims that they suspect of insurance fraud to the State of Florida. However, in my practice I have seen insurance companies accuse consumers, policy holders, insureds of insurance fraud, when in fact that is not the case. I think that sometimes it
gets used as leverage to try to deny a claim, or resolve a claim for less than the value of the claim. Claims like that have to be taken seriously, and should be investigated.
