What is the Effect of Selling Your Home While You Have a Pending Homeowner's Insurance Claim?

If a home will be sold while a homeowner’s insurance claim related to the property is still pending that does not necessarily mean that the claim will die with the closing of the sale. The claim may be assigned to the purchaser of the home at the time of closing.  Or the seller may retain rights to the claim at the time of closing.  However, a number of issues should be addressed during the sale and closing to properly preserve the claim.  Please consult with an experienced insurance claims lawyer prior to the sale of the home if you have a pending insurance claim.
