According to the National Highway Traffic Safety Administration, 5,973,000 motor vehicles accidents were reported nationally in 2006 with 4,193,000 of those accidents incurring property damage.

If your vehicle is leased or financed, your leasing company or bank will require that you purchase Collision and Comprehensive insurance coverage for your vehicle.  This is the type of insurance that covers your vehicle against property damage and theft.

In addition to automobiles, consumers often are required to purchase or choose to purchase similar policies for boats, trucks, trailers, motorcycles, jet skis, etc.

Case In Point

ThiefOur client, the insured under a collision and comprehensive automobile insurance policy, suffered the theft of her vehicle.  Fortunately, the vehicle was recovered within a few days with minor damage to the vehicle incurred as a result of the theft.  Our client took the vehicle to a local body shop for repairs and contacted her insurance company.  The body shop prepared an estimate of the repairs deemed necessary as a result of the theft.  The insurance company sent out an appraiser to inspect the vehicle at the body shop.  All of the dealings regarding damages to the vehicle took place between the body shop and the insurance company's appraiser and adjuster.  The insurance company subsequently denied the insured's claim.  As the basis for the denial, the insurance company claimed that the body shop had intentionally inflicted additional damage to the vehicle in order to inflate the cost of the repairs.  However, the insurance company proffered no evidence that the insured had any involvement with the body shop's claimed actions.  Although repeated requests were made during pre-suit and litigation for the insurance carrier to honor the insurance claim for those damages that were undisputedly related to the theft, the insurance company continued to deny the whole claim.  Even though there was no evidence that the insured had anything to do with the body shop's claimed conduct, the insurance company continued to punish the insured as opposed to prosecuting its complaints against the body shop.  As a result, the case moved forward to trial.  Just before trial was to begin, the insurance company settled the insured's claims for the damage to the vehicle, bad faith damages, attorney fees, and the costs incurred by the insured in prosecuting her claim.

Presenting your Claim - Document, Document,Document

Once your vehicle has sustained damage due to a covered event (for example, your vehicle was damaged in an accident or as a result of vandalism or theft) you need to begin to document your claim.  Put your insurance company on notice of the claim.  Call your insurance company and let them know what happened.  Get the name of the adjuster assigned to your claim, his or her contact information and the claim number.

Take pictures of the damage to the vehicle if possible (obviously you can't take photos of a stolen vehicle that has not been recovered).  Take video, if you can, of the property damage.  Hold on to any receipts and estimates for repairs.  Do not throw out any correspondence or documents that are sent to you by your insurance company.  If you are mailing anything to your insurance company do it by certified mail, return receipt requested, and make copies of whatever you are sending for your records.  Keep a journal of all your communications with your insurance company.  If you become aware of any witnesses that have knowledge of any aspect of your claim, record their name and contact information.  Don't throw out any of the damaged vehicle parts.  In short, document everything.

Claim Delays, Claim Denials

If your claim is being delayed by your insurance company or has been denied don't be surprised.  In particular, stolen vehicle claims in South Florida seem to come under unreasonable scrutiny by the insurance companies.
