Insurer Settles Lawsuit with Real Estate Developer for $42.5 Million D

Hurricane Dennis made landfall on the Florida panhandle on July 9, 2005. After the storm dissipated, a real estate developer's 31 story, 570 unit condominium project was significantly damaged. After the developer filed an insurance claim under its builder risk policy, the insurer, Axis Surplus Insurance Company, not only denied the claim in its entirety but also refused to renew the developer's policy.
