According to a Miami Herald article, one way to get your claim paid is by bribing the Citizens claims adjuster. Eric Garcia-Cebollero, a claims adjuster for Citizens Property Insurance Corporation, was arrested for shaking down homeowners, restoration companies, construction companies, commercial dry cleaning companies, and public adjusters for bribes. But here is the kicker: All charges were dropped against Garcia-Cebollero and his record was sealed and expunged in exchange for him ratting out those that he shook down. The insurance industry is always up in arms with allegations of rampant insurance fraud by consumers. But isn’t this insurance company fraud? Yep. But instead of law enforcement taking direct aim at the originator of the fraud, the insurance company and its employee, it flips the case into one against consumers and their representatives for insurance fraud. I guess that Citizens is not only immune from bad faith lawsuits but is also immune from criminal prosecution.
